Terms & Conditions


The basis on which requests are reviewed, quotations issued and work performed.

Acceptance

What is governed here is the submission of a request through cmmcalibrationindianapolis.com, the quotation issued in response, and the performance of CMM Calibration and related work arranged through this site. Submitting a request is acceptance of these terms; so is accepting a quotation issued in response to one. Any existing signed supply agreement, or agreed purchase-order terms, takes precedence over these terms to the extent of any conflict.

Review Before Quotation

Review of the request happens first, before a quotation is issued, and it confirms three things: that the requirement is stated clearly and understood, that the method, range and measurement capability needed are available, and that the laboratory selected to carry out the work is competent to perform it.

Where a statement of conformity is required, the decision rule to be applied is agreed in writing before work begins, as is the specification the item is to be assessed against. Any requirement that changes after acceptance is reviewed again and confirmed to the customer before work continues. Any request that cannot be met as specified is either declined or returned with an alternative scope; it is not accepted and quietly reduced.

Externally Provided Services

The technical work itself is externally provided, and the arrangement is set out here and not left to be inferred. Indianapolis CMM Calibration and Repair operates cmmcalibrationindianapolis.com as a marketing and referral website; it is not itself a calibration laboratory and does not perform the measurements described here. Requests are passed to external laboratories holding their own accreditation, operating their own quality management systems, and issuing their own certificates and reports.

Selection of an external provider is against stated criteria — current accreditation and the scope of it, demonstrated capability for the specific measurement requested, traceability arrangements, and record of on-time delivery. Ongoing monitoring follows, and a provider that ceases to meet the criteria is not used. Where a customer specifies that work must not be subcontracted, the instruction is honored or the request is declined.

Payment reaches the operator of this website in connection with that introduction, in the form of a referral fee, a fixed fee for the use of this website, or a commission on work that is placed. Stating it plainly keeps the commercial relationship behind the site from being left implicit. It does not alter the price quoted, and it gives the operator no role in performing, approving or certifying any measurement.

Quotations and Their Validity

Quotations are issued in writing and are valid for thirty (30) days from the date of issue unless a different period is stated on the quotation itself. Each one is built from the item description, quantity, measurement points, tolerances and turnaround supplied with the request.

Sometimes the item that arrives is not the item described: additional channels, a wider range, damage, or a condition needing repair before measurement is possible. Work is then held while a revised quotation is issued, and does not proceed until that revision is approved in writing.

Lead Times

Turnaround appears on the quotation in business days, and the clock starts on receipt of the item or receipt of written approval to proceed, whichever is later. Where capacity allows, expedited handling is available, quoted separately. Commitments are made in good faith against current capacity, and where one cannot be met, notice follows as soon as the delay is known — with a revised date.

Items and Risk

Items should arrive in protective packaging adequate for transit, with any accessories, fixtures, cables or software needed to complete the work. Unless carriage has been arranged and charged on the quotation, transit risk in both directions rests with the customer.

Unsafe items, contaminated items, and items outside the condition accepted at review are returned unworked, with the reason stated. Completed items are held at the customer's risk once the collection or despatch period agreed on the quotation has ended.

Payment Terms

Unless a credit account has been approved in advance, payment is due in full before certificates and items are released. Where credit terms have been approved, invoices are payable net thirty (30) days from the date of invoice.

Prices exclude taxes, duties and carriage unless the quotation states otherwise. Overdue balances may accrue interest at the lower of one and one-half percent (1.5%) per month or the maximum permitted by law. Further work may be suspended while an account is overdue.

Certificates, Reports and Ownership

The laboratory that performed the work issues the certificate or report, and it remains that laboratory's technical record. Payment in full gives the customer an unrestricted right to keep, copy and use the certificate for its own quality, audit and regulatory purposes.

Certificates are complete documents, and reproduction is in full or not at all — partial reproduction requires written approval. The performing laboratory retains copies for the period stated in its records policy, and a reissue is made against the original certificate number.

Confidentiality

Information obtained or created in the course of a request is treated as confidential. Drawings, specifications, tolerances, measurement results and the existence of the engagement itself are made available only to the personnel and providers who need them to complete the work, or where disclosure is required by law or by an accreditation body exercising its rights of access. Where the law requires disclosure, the customer is notified unless that notification is itself prohibited.

Limitation of Liability

The work is performed with reasonable skill and care and in accordance with the methods and standards stated on the quotation and on the resulting certificate. Where it is shown to be defective, re-performance of the affected work or a refund of the amount paid for it is the remedy, at the customer's election.

Total liability arising out of any engagement is limited to the amount paid for the work giving rise to the claim, to the maximum extent permitted by law. No liability is accepted for loss of profit, loss of production, loss of contract, or any indirect or consequential loss. Liability that cannot be limited by law is not limited here.

Governing Law

Governing law is that of Indiana, applied without regard to conflict-of-law principles, and the courts of that jurisdiction hear any claim unless a different forum has been agreed in writing.
